Contract and Guarantee of Good Health

We abide by the laws outlined in the PA Puppy Lemon Law (see enclosed copy) and give the additional guarantees outlined in this contract. Our guarantees are only between the seller and the original buyer, not to a 3rd party. Our dogs are AKC registered. The puppy is guaranteed to be suitable for the purpose for which the puppy was purchased.

I as a breeder of German Shepherd Dogs will always do my best to provide hardy, healthy, and happy puppies. My goal is to promote and better this wonderful breed. With my goal I will always try to produce better puppies than the parents.

Health Guarantee:
Our pups are guaranteed to be in good health at the time of sale. We strongly recommend that buyer have the pup examined by a licensed veterinarian of buyer's choice within 72 hours of receipt of pup. If you question your new puppy's health - get it into a vet right away. Do not wait 3 days. Ask the vet to please document, in writing, the condition of the pup, and the date and time you brought the pup in. If the puppy has a physical or genetic defect have this documented by your veterinarian. We will need proof of the defect, so send a copy of this to us via registered letter.

As the Breeder of your new puppy, I have done everything I can to insure that the health of your puppy is excellent. Understand that with genetics, and breeding dogs specifically, nothing is 100% guaranteed - although it is rare, even with the best of planning and breeding, undesirable genetic conditions do occur even out of normal, healthy parents.

If a life altering/threatening birth defect (any proven genetic defect that affects it's quality of life) is found other than cosmetic (i.e. non erect ears, missing tooth, umbilical hernia, tail kink, etc.), within the first 2 years from the pup's birth, We will replace the pup with one of equal value from next available litter. We do not require you to forfeit your pup in the event that it must be replaced. We allow you to keep your dog, but it must be spayed or neutered, with proof being supplied to our satisfaction prior to proceeding with a replacement pup.

Puppies sold on show/breeding contracts that can live a normal pet life but are unsuitable for breeding due to a genetic condition must be spayed/neutered. A written diagnosis by a veterinarian must be provided before a replacement will be allowed. Buyer is not required to return the puppy. If Buyer chooses to keep the puppy, Seller will allow a new puppy of equal value at half price. If Buyer chooses to return the puppy, a new puppy of equal value will be given. Proof of altering must be received before a replacement will be allowed. If Buyer has allowed the puppy to breed, then Buyer accepts the puppy to be in good health and no guarantee will be honored. Puppies sold on show/breeding contracts that are unable to live a normal pet life due to discomfort from a genetic condition will be replaced with a puppy of equal value. A written diagnosis by a veterinarian must be provided before a replacement puppy will be allowed. If Buyer has allowed the puppy to breed, then Buyer accepts the puppy to be in good health and no guarantee will be honored.

Puppies sold on non-breeding contracts that are unable to live a normal pet life due to discomfort from a genetic condition will be replaced with a puppy of equal value. A signed diagnosis by a veterinarian must be provided before a replacement puppy will be allowed. If Buyer has allowed the puppy to breed then no guarantee will be honored. If you have purchased a Pet Quality puppy and the puppy is diagnosed with a health condition that requires euthanasia or causes sudden death, you will be given a replacement puppy of equal value. Please Note - Seller reserves the right to a second opinion prior to euthanasia. If you do not give us this right to a second opinion, no replacement puppy will be offered.

Refund or replacement will only be made after the seller receives the veterinarian certification. This certification will state: the buyer's name and address; the date the dog was examined; the breed and age of the dog; that the dog has an illness or defect which renders it unfit for purchase; the precise findings of the examination; any recommended treatment and the fees associated with the treatment; and the veterinarian's name, address, telephone number and signature. His diagnosis must be signed with his license and telephone number and sent to the seller The buyer is responsible for bearing the expense of the certification.

Seller shall have the right, within 2 business days of notification of a condition which renders the dog unfit for purchase to require buyer to produce the dog for examination by a licensed veterinarian designated by the seller. Failure to produce the dog within 2 business days from notification will nullify any obligation to reimburse, refund or replace by the seller.

If pup is found to have a life threatening, hereditary defect, the seller will then proceed with a replacement pup. All expenses for the above mentioned procedures are the sole responsibility of the buyer. If buyer wishes to return the pup, then any & all shipping charges are the sole responsibility of the buyer. The seller shall not be held responsible for the development of any faults, diseases, or disorders, which are due to buyer's negligence.

THIS GUARANTEE DOES NOT WARRANT THAT THIS DOG HAS BEEN EXAMINED BY A VETERINARIAN. THE PURCHASER IS ENCOURAGED TO HAVE THIS DOG EXAMINED BY A VETERINARIAN AS SOON AFTER PURCHASE AS IS FEASIBLE.

Nutrition:
Buyer agrees to feed a quality kibble, home cooked diet, or raw diet for the life of the dog.

Vaccinations and Worming:
Puppies receive their first set of shots at 8 weeks old. They then need booster shots at 12 weeks, 16 weeks and 15 months of age. Puppies will have been wormed while in our care. The seller will have administered the puppy shots and worming medicine. Rabies shots and heartworm treatments should be given as your vet recommends for your area. Puppies still in our care at 12 weeks of age will receive their first rabies shot at that time. Future vet visits by the buyer should include further worming and the balance of booster shots that are needed and any other needed medical treatment to keep the pup in optimum health. Neglect in worming, veterinary care or nutrition will nullify any & all guarantees.

I do understand that many dog owners now wish to have a natural and vaccine free life for their pets. Please let me know if this is your desire and we will discuss the options.

Do not take the pup into parks, pet stores, or other public places where other dogs frequent until at least 4 months of age. Keep risk of exposure to parvo, corona, distemper, kennel cough, etc (all communicable diseases) to a minimum. We do not guarantee against communicable diseases.

Although every precaution has been taken to insure that your puppy does not have worms, they are a very common occurrence in puppies and can re-occur after treatment. Coccidia and Giardia are other common puppy problems, and although we do not have a problem with it on our premises as we strive to keep it from becoming an issue, over 30% of all puppies carry these protozoa. Some immune systems seem to handle it better than others, while some require medication to get over it. Coccidia is caused by a protozoa passed through feces that are ingested. Giardia can be contracted by drinking stagnant water, or by chewing on an infected stick. None of these are considered life threatening unless left untreated and are therefore not covered under the health guarantee.

Hip/Elbow Guarantee:
This pup is guaranteed to be free of moderate or severe hip and or elbow dysplasia up to the age of 30 months. This guarantee does not cover dysplasia due to injury or improper nutrition. Obesity, dietary deficiency, environmental conditions or over exertion and other preventable reason is not guaranteed. If pup has not been x-rayed or diagnosed by the time pup reaches 30 months, this guarantee is void. If pup has been used for breeding, the guarantee is void.

Puppies sold on show/breeding contracts who do not pass OFA or PennHip and receive a moderate result of dysplasia are still able to lead a normal pet life and will be considered Pet Quality and a replacement puppy of Show Quality will be offered at half price. Puppies who receive a report of severe dysplasia will be refunded a replacement puppy of Show/Breeding Quality free of charge.

Pet Quality Puppies who are diagnosed with hip or elbow dysplasia must also have reports sent to OFA or PennHip to confirm diagnosis. The dog must be in obvious pain and this must be documented by a veterinarian. A replacement Pet Quality puppy will be offered at half price (for a report of moderate). If a Pet Quality puppy is diagnosed with severe dysplasia, a replacement Pet Quality puppy will be offered at no charge.

In order to have the pup replaced, the buyer must do the following: Have the pup x-rayed by a licensed veterinarian. The diagnosis must be signed with his license and telephone number, and returned to the seller. The x-ray must be mailed to the OFA for grading or to Pennhip for evaluation. A copy of the certification must be mailed to the seller along with a copy of pup's AKC papers, and with an explanation of the buyer's intents regarding the pup. Communication must be kept open between buyer & seller.

Buyer must also have the pup spayed or neutered and provide a letter of verification from his licensed veterinarian to the seller. If the buyer does not wish to keep the pup, it must be returned to the seller at the buyer's expense. All expenses for the above mentioned procedures are the sole responsibility of the buyer. When ownership is transferred the dog's registration certificate shall be signed over to the new owner. Buyer shall be responsible for taking good and responsible care of the dog until seller receives it. After all the above procedures have been completed, the seller will then proceed with pup replacement. Any and all additional shipping charges are the sole responsibility of the buyer. The pup becomes the responsibility of the buyer at the time of sale. In the event that this puppy must be destroyed due to the severity of hip dysplasia, a written form of veterinarian findings must be given to seller. Seller reserves the right to a second opinion prior to euthanasia. If you do not give us this right to a second opinion, no replacement puppy will be offered.

By signing this contract, the buyer acknowledges they have been informed young bones do not properly calcify until 12 months of age. Buyer acknowledges we will guarantee the hips and elbows providing the buyer agrees they will not allow environmental conditions to adversely affect the development of the hip and elbow structure. Buyer will provide a nutritionally complete food that will not promote excessive growth or obesity. Buyer will provide regular moderate exercise. The buyer is aware if they allow the dog to engage in activities that would stress the hips before the age of 10 months the hip and elbow guarantee becomes null and void. Activities include, but not exclusively, exercise on hard unyielding surfaces, continuous running, repetitive jumping, training in competitive dog sports, or any activity that may cause injury.

No refunds will be given for a report of Panosteoitis (growing pains), as this can be controlled by proper feeding and the puppy will outgrow it.

First Right of Refusal:
We will take back any puppy that we produce or sell. If at any time during your dog's life, for any reason, the Buyer finds themself unable or unwilling to continue to care for this dog then the Buyer agrees to contact the Seller FIRST and agrees to the following terms of return:
Buyer agrees to first contact the seller and give them the option to reclaim said dog at no charge. Upon notification, the seller shall have 15 business days to exercise this option. Any other transfer of this dog without written permission of the seller shall make the buyer liable for $1000.00 in damages, payable upon demand to the seller.
Buyer agrees to return the dog to Seller with no expectation of any refund of the purchase price. Buyer further agrees to either transport the dog to Seller, or to pay for shipping/transportation fees.
Buyer agrees that at the time of transfer of the dog back to the Seller that all registration papers and medical records will be turned over to the Seller, and all necessary paperwork will be signed transferring ownership back to the Seller.
If the dog in question has a permanent form of identification, such as a Microchip or Tattoo, the Buyer agrees to contact the agency that the dog is registered with and have the ownership/contact information for the dog transferred into the the Sellers name. Buyer agrees to have this completed within 24 hours of when the dog is given back into the Seller's care. Buyer agrees that at no time will they, without prior written permission from Seller, sell, give, trade, or adopt, this dog to any person, business or organization. Please remember this prior to surrendering your puppy to a shelter or to someone else. Not contacting us prior to selling or placing the puppy/dog, will result in a BREECH OF CONTRACT!

Temperament:
The seller makes no representations or warranties, expressed or implied, about the dogs temperament and is absolved from any liability for future damages or injuries caused by the dog after purchase. The seller further gives no guarantees, expressed or implied, of the suitability of the dog to the buyer and/or his or her family.

Seller recommends that buyer attend obedience classes with dog and provide proper socialization opportunities for dog. The personality of a puppy is well developed by 4-6 months of age and improper socialization (or lack of) can result in an overly anxious/or fearful puppy when attempting socialization as a much older pup or adult. A well mannered puppy does not just happen, your puppy will become what you allow him to become. The importance of obedience class and socialization for a German Shepherd puppy cannot be stressed enough.
